We often recommend you execute both a “Durable General Power of Attorney”, as well as a “Durable Health Care Power of Attorney” to supplement your overall estate plan to help "plan for the unexpected."
A “Durable General Power of Attorney” appoints an agent (including one or more alternate agent(s) if you choose) to act for you in connection with paperwork (including financial matters and to help manage certain assets).
This type of POA does NOT include designating medical decision making authority (that is a separate POA).
For Durable General Powers of Attorney, we recommend you make them effective immediately upon execution.
For any agent that you appoint, we STRONGLY RECOMMEND that you choose persons whom you know, love, and trust to serve. We also recommend that you PLEASE talk with them NOW to make sure they are on board with serving as your agent, and that they also understand your wishes and desires for serving as your agent.
We recommend that you list a primary agent to serve, and also at least one "alternate agent" as a backup who can serve if your other agent cannot or chooses not to do so.

A “Durable Health Care Power of Attorney” appoints an agent (including one or more alternate agent(s) if you choose) to make health care decisions for you in the event of incapacity. It is crucial that you share your "healthcare wishes" with your agent(s) NOW, while you still have the capacity to do so, in case they are ever required to convey your wishes to your health care providers if you are unable to do so yourself! Don't get caught in this nightmare situation!

We also recommend that you PLEASE talk with them NOW to make sure they are on board with serving as your agent, and that they also understand your wishes and desires for your healthcare decisions.

With regard to the “Durable Health Care Power of Attorney”, it is also important to nominate persons who will act as a strong advocate for you and on your behalf when you are unable to do so.
